Terms & Conditions of Purchase

These Terms & Conditions govern all orders placed with Gaucha Empanadas, including catering services, delivery, and pick-up.

By placing an order, you agree to the following:

1. Orders & Payments

  • All orders must be confirmed in writing via email, online form, or direct message.

  • Full payment is required prior to pickup or delivery unless otherwise agreed upon in writing.

  • For catering services, a deposit may be required to reserve your event date. Final payment is due before or on the day of the event.

  • Bookings are confirmed on a first-paid, first-served basis.

2. Cancellations & Refunds

  • Catering orders may be canceled up to 72 hours before the event for a full refund.

  • Cancellations made within 72 hours of the event are non-refundable.

  • Pickup and delivery orders may be canceled up to 24 hours in advance for a full refund.

  • No-shows, missed deliveries, or same-day cancellations are non-refundable.

3. Delivery & Pick-Up

  • Delivery is available within designated service areas and is subject to a delivery fee.

  • A responsible party must be available at the time of delivery. We are not liable for food left unattended.

  • For pickups, please arrive within the scheduled window. Unclaimed orders will not be refunded.

4. Food Allergies & Dietary Needs

  • Gaucha operates in a kitchen that uses common allergens, including but not limited to gluten, dairy, eggs, nuts, soy, and sesame.

  • While we take precautions, we cannot guarantee a completely allergen-free environment.

  • It is the customer's responsibility to inform us of any allergies or dietary restrictions prior to placing an order.

5. Changes to Orders

  • We will do our best to accommodate changes, but major changes requested within 24–48 hours of fulfillment may not be possible.

  • Any changes or additions may impact the final invoice amount.

6. Menu Availability

  • Our menu may rotate seasonally and certain items may only be available by special request.

  • We reserve the right to make substitutions based on ingredient availability, with notice provided whenever possible.

7. Reheating & Food Handling

  • Some orders are delivered cold with reheating instructions.

  • Gaucha is not responsible for food quality or safety once the product has been delivered or picked up.

  • Proper storage and reheating are the customer’s responsibility.

8. Weather, Venue & Force Majeure

  • We reserve the right to adjust or pause operations due to severe weather, venue access restrictions, safety issues, or other events beyond our control.

9. Photos & Marketing

  • Unless requested otherwise in writing, Gaucha reserves the right to photograph catered events or menu items for promotional use, including on social media and marketing materials.

10. Liability

  • Gaucha is not responsible for delays due to traffic, weather, or venue issues beyond our control.

  • Once food is delivered or picked up, the customer assumes responsibility for safe handling, storage, and consumption.
